Mr.Rajendra Prasad Nat ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 103(1), 238, 118(1), 118(2), 61(2), 3(5) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, in brief, is that the informant's father paid Rs. 10,000/- to each and every worker
Patna High Court CR. MISC. No.66017 of 2025(2) dt.22-09-2025 2/3 (accused person) for doing work in advance, but after receiving the aforesaid amount, all the accused persons refused to work. It is further alleged that on 18.04.2025 at about 07:00 PM, father of the informant went to the house of co-accused Rajesh Rishi for talking about work, but till night, he did not return and on the next morning, the dead-body of informant's father was recovered near bank of canal. Informant suspects that all the F.I.R. named accused persons including these petitioners committed murder of his father.
4. Learned counsel for the petitioners submits that informant is not eye-witness to the occurrence and has raised only suspicion against petitioners and others. During course of investigation, no direct or indirect material has come to show complicity of these petitioners in the alleged occurrence. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.66017 of 2025(2) dt.22-09-2025 3/3 satisfaction of learned J.M. 1st Class, Katihar in connection with Rautara P.S. Case No. 60 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
