The petitioner apprehends his arrest in connection with Gamharia P.S. Case No. 129 of 2012 registered under Section 366(A) of the Indian Penal Code.
The accusation is of kidnapping of Kajal Kumari, minor daughter of the informant, by Lalo Yadav and petitioner with the help of four others named in the F.I.R. for the purpose to perform the marriage.
Learned counsel for the petitioner submits that after recovery of daughter of the informant, her statement was recorded under Section 164 of the Cr.P.C., in which, she has not disclosed the name of the petitioner involving in her kidnapping
Patna High Court CR. MISC. No.58450 of 2019(2) dt.18-09-2019 2/2 rather she disclosed the name of Lalo Yadav, Arbind Yadav, Binod Kumar, Sunil Yadav and two unknown, who involved in her kidnapping. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Gamharia P.S. Case No. 129 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
