The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Khagaria P.S. Case No. 328 of 2016, registered for the offence punishable under sections 419, 420, 467, 468, 471 and 34 of the Indian Penal Code.

As per allegation made in the F.I.R., one Abdul Quadir was caught hold of while giving the examination of Maulbi in place of the petitioner.

It is submitted by the learned counsel for the petitioner that from perusal of the FIR, no offence is made out against the petitioner. It is Abdul Quadir, who was impersonating the petitioner. Petitioner has no criminal

Having heard the learned counsel for the parties and taking into consideration the fact and circumstances of the case, the above named petitioner is directed to surrender in the court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 328 of 2016, subject to the condition as laid down under section 438(2) of the Cr.P.C.
