Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
The prosecution case is that on 16.08.2007 coaccused Dhenu Hembram and Ward Member Pradhan took the step son of the informant Dinesh Rishideo, thereafter he went missing. Subsequently, his dead body was recovered from the embankment of Kamla river kept in a gunny bag. It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. The impugned order does not suggest that any cogent material has been collected during investigation against the petitioner and investigation against the petitioner is still
Patna High Court Cr.Misc. No.56135 of 2015 (2) dt.10-12-2015 pending, though the others have been charge-sheeted. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Forbesganj P.S. Case No. 299 of 2007, pending in the court of learned Chief Judicial Magistrate, Araria.
With this observation this application is disposed of.
