The petitioner seeks regular bail in a case registered for the offence punishable under Sections 302, 307, 341, 323, 504, 147, 148, 149 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of indiscriminate firing upon the brother of the informant and during treatment he died.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. The co-accused have been granted bail by a Co-ordinate Bench of the court vide order dated 25.02.2019 in Cr. Misc. No. 10671/2019 and dated

Patna High Court CR. MISC. No. 58333 of 2019(4) dt.06-02-2020 2/2 11.04.2019 in Cr. Misc. No. 15608/2019. The petitioner is in custody since 05.07.2019.

Heard learned APP also.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, in connection with Sourbazar (Patarghat O.P.) P.S. Case No. 600 of 2018, subject to the following condition that the petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
