2. The petitioner seeks bail in connection with Tilakeshwar P.S. Case No. 69/2024 registered for the offence under Sections 64, 77, 61(2), 3/5 BNS and 67(A) of the I.T. Act.

3. The accused/petitioner is named in the F.I.R. and is in custody since 20.05.2025.

4. As per FIR, petitioner was alleged to capturing video of rape/penetrative sexual assault which was committed by co-accused Satyam Kumar Paswan upon the informant, who is married lady of 38 years old.

5. Learned counsel appearing on behalf of

No.62516 of 2025(3) dt.20-11-2025 2/3 the petitioner submitted that after investigation police submitted final form in this case even against co-accused Satyam Kumar Paswan, against whom the allegation of rape is available and, therefore, the allegation qua petitioner as to capture the video of the occurrence not appears convincing. While concluding argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence. Petitioner claimed clean antecedent.

6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of fact as the allegation of rape against main co-accused found false upon investigation prima facie making the allegation doubtful as raised against this petitioner to capture the video of the occurrence, coupled with the fact that investigation of this case is already completed, where petitioner being man of clean antecedent, remains in custody since

Case No. 69/2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned I/c Principal District & Sessions Judge, Camp Court, Biraul Darbhanga/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
