Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Raushanganj (Bankebazar) P.S. Case no. 133 of 2019, registered under Section 414/34 of the Indian Penal Code. The accusation is that on receiving information about identification of thieves committing theft of vehicles from nearby S.B.I. and P.N.B. through C.C T.V. footage, the informant along with other Police personnel reached at villageBarkijot at the house of Sanjeet Kumar. On search, Aadhar Card and Pan Card recovered in the name of Satya Narayan

Patna High Court CR. MISC. No.59287 of 2019(2) dt.20-09-2019 2/3 Yadav, whose motorcycle was stolen from nearby P.N.B. Sanjeet Kumar disclosed about committing of theft of motorcycle with the help of his associate Sintu Kumar (Petitioner) and he, further, disclosed about keeping of theft motorcycle by the petitioner in the north of Nabadih forest. Thereafter, informant along with other Police personnel reached there and recovered one Splendor motorcycle at the instance of Sanjeet Kumar.

Learned counsel for the petitioner submits that, although, petitioner is named in the F.I.R., but nothing has been recovered from his possession. The name of the petitioner came in the confessional statement of co-accused Sanjeet Kumar from which theft motorcycle was recovered. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Sherghati, Gaya in connection with Raushanganj (Bankebazar) P.S. Case No. 133 of 2019, subject to the condition as laid down under Section
