JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420, 467, 468 and 471 of the Indian Penal Code. Allegation against petitioner is that he along with his son with forged documents sold a land to informant with consideration amount of Rs.4,25,000/-. Out of the total money, informant paid Rs.2,00,000/- but petitioner did not execute the land in favour of informant. Thus, he cheated informant.
It has been submitted on behalf of petitioner that he is in custody since 9.10.2016. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. The matter relates to civil dispute. Vide Annexure-2 the matter has been compromised between the parties. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.52029 of 2016 (2) dt.08-12-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case no. 773 of 2016.
