JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that four persons surrounded the informant, made assault with fists and slaps when one of them resorted to fire, though no injury was caused to anyone. The petitioners were identified by the informant. It is submitted by learned counsel for the petitioners that for a petty dispute, earlier also the informant filed two other cases and admittedly no injury was caused to the informant.

It is submitted by learned counsel for the informant that due to the earlier enmity the offence was

Patna High Court Cr.Misc. No.53809 of 2015 (2) dt.26-11-2015 2/2 committed by the accused persons.

Considering the nature of accusation in the background of enmity from before, it is a case for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Andar P.S. Case No. 100 of 2015, pending in the Court of learned Chief Judicial Magistrate, Siwan.

With the observations above, the application stands disposed off.
