2. The petitioner is in custody in a case register for the offence punishable under Section 137 of BNS, 2023.
3. As per allegation in the FIR, while the informant and his wife returned to their house from the work, they did not find their daughter at their house. Thereafter they started searching and inquiring to the neighbours and relatives but they were unable to traced out her.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He next submits that the name of the petitioner has figured only on the basis of suspicion, petitioner is not
Patna High Court CR. MISC. No.61704 of 2025(4) dt.10-12-2025 2/2 named in the FIR as well as no independent witness who had saw the alleged occurrence. He further submits that as per the Postmortem report, the cause of the death of the daughter of the informant was due to drowning and Asphyxia. Petitioner is in custody since 10.02.2025 having one antecedent as stated in the para-3 of the petition.
5. Learned counsel for the APP opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case as well as the fact the deceased died due to drowning, let the above named petitioner be released on bail on furnishing bail bond Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional Sessions Judge-III, Sherghati, Gaya in connection with Amas P.S. Case No. 275 of 2024.
