In this case, the petitioner is claiming that the admitted amount of Rs. 3,09,266/- be released in his favour as he has executed the work in terms of the Agreement No. 6H2 15-16. The tender was floated, the petitioner filed the tender in sealed cover, the work valuing Rs. 3,09,266/- was allotted to him which he has completed in terms of the agreement. The petitioner has submitted the bill but, the payment was not made to the petitioner which compelled him to approach before the Chief Engineer, Building

Patna High Court CWJC No.7773 of 2017 dt.25-07-2017 Construction Department, Patna who gave direction for payment of the admitted bill to the petitioner but, the petitioner is moving from pillar to post till today with empty hand.

In that view of the matter, let the petitioner should file a detailed representation to the Commissioner-cum-Secretary, Department of Building Construction, Bihar, Patna who will be obliged to consider the grievance of the petitioner and if it is found that the petitioner has carried out the work successfully in terms of the agreement, in such circumstances, the admitted amount should be paid to the petitioner within a period of eight weeks from the date of filing of the representation by the petitioner.

With the aforementioned observation and direction, this application is disposed of.
