2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 379, 307, 504, 506 and 34 of the Indian Penal Code.
3. As per prosecution case, it is alleged that on 14.01.2024 at about 9 AM, all the F.I.R. named accused persons, including this petitioner, abused informant and on objection, coaccused Mallu Sahni assaulted on the head of informant with iron rod. It is further alleged that when nephew of informant came to save, co-accused Mallu Sahni and Sonu Kumar assaulted him with iron rod and co-accused Wakil Kumar inflicted knife blow.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.62199 of 2025(2) dt.28-11-2025 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that specific accusation of assault is against co-accused Mallu Sahni, Sonu Kumar and Wakil Kumar. So far as this petitioner is concerned, there is absolutely no allegation of assault and he is only alleged to be member of the mob. Moreover, co-accused Mallu Sahni has already been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 21.07.2025 passed in Cr. Misc. No. 30940 of 2025. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First
