ANJANA MISHRA ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 10.08.2019 in connection with Sadar Circle Excise Case No. 37 of 2019, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not made from his conscious possession and he was only standing and waiting for transport near Bhangia Tola when the alleged recoveries have been made. It is further submitted that neither the petitioner is buyer nor seller and he has no criminal antecedent.

Considering the aforementioned facts and
