The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 323, 341, 448 and 307 of the Indian Penal Code. The accusation is of making assault.

Though, there is no specific accusation against the petitioner. It is submitted by learned counsel for the petitioner that though the case has been instituted in 1998 but the petitioner is the resident of different village. Since the case was instituted in 1998, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the

Patna High Court Cr.Misc. No.55451 of 2015 (2) dt.07-12-2015 2/2 prayer for regular bail of the petitioner keeping in view of the fact that the others have been granted bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bihta P.S. Case No. 167 of 1998 pending in the court of learned Additional Chief Judicial Magistrate, Danapur.

With the aforesaid observation, this application is disposed of.
