JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and learned APP representing the State.
The petitioner apprehends his arrest in connection with Madhepura P.S. Case No. 81 of 2017 registered for the offences punishable under Sections 406, 420 of the Indian Penal Code, Sections 63, 65 of the Copy Right Act and Sections 103 and 104 of Trade Mark Act.
Allegedly, the petitioner violated the provisions of various sections of the Indian Penal Code as well as Sections 63, 65, of Copy Right Act and Sections 103, 104 of Trade Mark Act. Submission is of false implication and that there is nothing available on the record to show the complicity of the petitioner, no offence is made out against the petitioner under the aforesaid sections. Similarly situated co-accused Uma Kant Bhagat has been allowed pre-arrest bail vide Cr.Misc. No. 17728 of 2017 on
Patna High Court Cr.Misc. No.24964 of 2017 (2) dt.14-07-2017 25.04.2017 by another co-ordinate Bench of this Court and as such the petitioner also deserves sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering that co-accused Uma Kant Bhagat has been allowed pre-arrest bail, the petitioner above named, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 81 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
