1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Motihari Town P.S. Case No. 294 of 2024 dated 23.05.2024 registered under Sections 363, 366 and 34 of the I.P.C.
3. As per the F.I.R. the daughter of the informant went for attending beauty parlour course but did not return till late night and upon enquiry the informant came to know that the petitioner alongwith the co-accused / Deepu Kumar and others kidnapped his minor daughter for the purpose of marriage.
4. Learned counsel for the petitioner submits that from perusal of the first information report it is clear that the victim girl was having love affair with co-accused Deepu Kumar. The statement of the victim girl was recorded under Section 164
Patna High Court CR. MISC. No.72156 of 2024(2) dt.29-10-2024 2/2 Cr.P.C. in which she has stated that on the fateful day she left her home alone for Muzaffarpur and stayed there for 5-6 days and when money got exhausted she returned to her house.

Regard being had to the submission made by the parties, taking into consideration the fact that the victim girl was having love relationship with the co-accused Deepu Kumar and in her statement recorded under Section 164 Cr.P.C. she has not disclosed the name of the petitioner, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. Case No. 294 of 2024 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
