This is a petition for grant of regular bail for offence under Sections 457 and 380 of the Indian Penal Code. The first information report of theft was lodged against unknown criminals, recovery of stolen property is alleged against the co-accused, Sajjan Saw, and the name of the petitioner has transpired in the confessional statement of co-accused, Md. Ijhar. Submission is that nothing has been recovered from the possession of the petitioner and suspicion is there due to criminal antecedent of the petitioner, disclosed in paragraph 3 of the bail petition.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kotwali (Barari) P.S. Case No. 314 of 2016 to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, or successor Court.
