JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Singheshwar P.S. Case No. 108 of 2015 instituted for the offence under Section 392 of the Indian Penal Code.

It has been submitted that petitioner is not named in the written report. His name has been taken by co-accused Sonu Singh who was apprehended by the police during course of investigation. It has further been submitted that in the seizure list, it is mentioned that the alleged motorcycle was recovered from possession of this petitioner, but from the impugned order it appears that the seizure list does bear the signature either by the petitioner or his family members.

No.23677 of 2017 (2) dt.23-05-2017 2/2 From the written report it appears that co-accused Sonu Singh was apprehended by the police who disclosed the name of this petitioner in his confessional statement. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Singheshwar P.S. Case No. 108 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
