JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 The petitioner seeks regular bail in connection with Atari P.S. Case No. 11 of 2017, registered for offences punishable under Sections 395 and 397 of the Indian Penal Code. Petitioner is named in the F.I.R and he has been identified in this case in the light of vehicle. It has been submitted on behalf of the petitioner that though he has been named in the F.I.R but nothing has been recovered from the possession of the petitioner and he has falsely been implicated in this case and further though he is an accused in another case of similar nature but he has not been remanded in that case. Petitioner has been in custody since 02.02.2017. Heard learned A.P.P. also.
Having heard both sides, considering the fact that
Patna High Court Cr.Misc. No.27159 of 2017 (2) dt.12-07-2017 2/2 petitioner has been named in the F.I.R, I am not inclined to release the petitioner on bail at this stage, his application for regular bail is, accordingly, rejected.
However, petitioner may renew his prayer for bail, once the informant is examined in this case and that and if any such application is filed, the court below after considering the materials available on record, shall pass an appropriate order. (Vinod Kumar Sinha, J) sunil/- U T
