The petitioner seeks bail in a case instituted under Sections 413, 414, 420, 467, 468 and 471 of the Indian Penal Code.
The allegation against the petitioner is that he is said to have been caught hold with motorcycles and on the basis of disclosure near about 11 stolen motorcycles are said to have been recovered from the garage of co-accused namely Kanhaiya Kumar.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.07.2016. The charge sheet has been submitted in the present case. There is no allegation of
Patna High Court Cr.Misc. No.52678 of 2016 (2) dt.16-12-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. He had no knowledge regarding the motorcycle in question was stolen property. The other co-accused have been granted bail vide Annexure-2 to the present application.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N.P. Singh, J.M.1st Class, Bettiah, in connection with Sathi P.S. Case No. 96 of 2016. (Sudhir Singh, J.) Amit/- U T
