The petitioner is apprehending his arrest in connection with Ariyari P.S. Case No. 70/2015 for the offences instituted under Sections 341, 323, 325, 379, 307, 337, 338, 504/34 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that this petitioner and alongwith co-accused collectively began to abuse on the issue of old dispute relating to land and drainage and when same was protested, all the accused persons started pelting bricks and stones, as a result of which, Jitendra Kumar sustained injury on the head and he was seriously injured. Patna High Court Cr.Misc. No.25056 of 2017 (2) dt.19-07-2017 2/2 pistol, as a result of which, the informant sustained injury on the thump of left hand. It is alleged that all have assaulted with intention to kill. It is further alleged that Rs. 15,000/- has been snatched.

Earlier anticipatory bail application of the petitioner was rejected vide Cr. Misc. No. 48523 of 2015. This is second attempt on behalf of the petitioner for grant of anticipatory bail. Considering the aforesaid facts and circumstances of the case, I am not inclined to interfere with the earlier order. The anticipatory bail application of the petitioner is rejected in connection with Ariari P.S. Case No. 70/2015, pending in the court of learned S.D.J.M., Sheikhpura. If the petitioner surrenders in the court below and prays for regular bail within a period of four weeks from today which shall be considered by the court below on its own merit without being prejudiced by the order of this Court, if possible, the same may be disposed of preferably on the same day.
