2. The petitioner is apprehending his arrest in connection with Muffasil P.S. Case No. 704 of 2023 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code, Section 25(i-B)a, 26 and 35 of the Arms Act and Sections 8, 20(B), II(B) of the NDPS Act.

3. After some argument, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.70820 of 2024(2) dt.22-10-2024 2/2 learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order considering the fact that the petitioner has no criminal antecedent.
