2. The petitioner is seeking regular bail in connection with Belsand P.S. Case No. 40 of 2024 for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act.
3. As per allegation, the accused persons including the petitioner kidnapped the minor daughter of the informant and hatched the conspiracy to kill her after sexual harassment.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that during investigation, the statement of grandfather of the victim has been recorded in which, he has stated that the victim had gone with co-accused Gulten Kumar. So far as this petitioner is concerned, he was working in the hotel of victim's father and this fact has been mentioned in paragraph nos. 7, 8 and 12 of the bail petition. He
Patna High Court CR. MISC. No.66355 of 2024(2) dt.25-09-2024 2/2 has also submitted that the petitioner is a person of clean antecedent and is under custody since 02.05.2024.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned ADJ-VI-cum-Special Judge, POCSO Act, Sitamarhi in connection with Belsand P.S. Case No. 40 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
7. Before accepting the bail bond, the court below will ensure that the submissions made by learned counsel for the petitioner as mentioned in paragraphs 7, 8 and 12 of the bail petition are correct and in that circumstances, the bail bond of the petitioner shall be accepted. The verification must be done within ten days from today.
