JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2015 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is named but admittedly, the injury sustained is the simple in nature except one injury which is on the forearm of the injured. Sofar as allegation of firing is concerned, admittedly, no fire arm injury was found on the person of the injured.

Contention on behalf of the petitioner is that the petitioner was in jail custody for near about 13 years in connection with another case and when he came out from the jail, the informant, in collusion with the police, lodged this false case. Considering the aforesaid facts and circumstances as

No.54535 of 2015 (2) dt.08-12-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Pandey, J.M. 1st Class, Bettiah, West Champaran in Shikarpur P.S. Case No. 192 of 2013.
