The petitioner is seeking regular bail in connection with Kishanganj P.S.Case No.473 of 2016 registered for the offences under Sections 302, 201, 120(B), 34 of the Indian Penal Code.
The prosecution story, as alleged in the FIR, would show that the dead body was recovered from Pucca Pool. The informant alleged illicit relationship against one co-villager, namely, Pinky Devi, who had allegedly called the deceased. It
Patna High Court Cr.Misc. No.25443 of 2017 (2) dt.07-06-2017 2/2 further alleges that the said Pinky Devi in conspiracy with one Yogen Sah committed the offence.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. His name has come on the basis of confessional statement of said Pinki Devi. He has drawn my attention to Annexures 3 and 4 to the petition to show that Yogen Sah was granted anticipatory bail by a co-ordiante bench of this Court in Cr. Misc. No.14850 of 2017 and Pinki Devi has also been enlarged on bail by a co-ordiante bench of this Court vide order dated 16.02.2017 in Cr. Misc. No. 54096 of 2016. Learned A.P.P. opposed the prayer for bail.
Considering the fact that the petitioner is not named in the FIR and the named accused persons have already been granted bail, let above named petitioner be released on bail on furnishing bail bond of Rs. `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kishanganj in Kishanganj P.S.case No.473 of 2016.
