JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 147, 148, 149, 341, 323, 337, 427, 353 and 295A of the Indian Penal Code.
Allegation against petitioners is that they were also members of the mob who indulged in violating law and order during procession.
It has been submitted on behalf of petitioners that they are in custody since 14.10.2016. They have got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. They have been made accused due to mistake of fact. General and omnibus allegation has been made against petitioners. No specific overt act has been alleged against petitioner.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.
