2. The petitioner seeks bail in a case registered for the offence under Sections 109, 3(5) of the B.N.S. and Section 27 of the Arms Act and later on, Section 103 of B.N.S. was added.
3. As per F.I.R., on 06.10.2024 at about 10 PM, informant's brother, who was conductor in Singh Travels, shot by some unknown persons near Masaurhi More and later on, in course of treatment, he died.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation in the confessional statement of co-accused Gaurav Kumar, who has already been granted bail by a coordinate Bench of this Court, vide order
Patna High Court CR. MISC. No.61730 of 2025(4) dt.12-12-2025 2/2 dated 22.03.2025 passed in Cr.Misc. No. 88867 of 2024 (Annexure - 2). Only material, which has come against petitioner, is that he was also present at the place of occurrence. There is absolutely no allegation against this petitioner that he participated in the alleged occurrence. Petitioner is in custody since 16.05.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State has opposed the bail petition.
6. In the facts and circumstances of this case as well as period of custody, let the petitioner, as named above, be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Patna in connection with Ramkrishna Nagar P.S. Case No. 784 of 2024.
