The petitioner being the Panchayat Secretary is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420 and 421 of the Indian Penal Code.
The accusation against the petitioner is of committing financial irregularities to the tune of Rs.4,49,200/- under old age pension scheme and not handing over the charge. It is submitted by learned counsel for the petitioner that the amount has already been deposited in the Block Nazarat which gets reflected from the letter of Block Development Officer, Tilauthupur addressed to the Officer-in-
Patna High Court Cr.Misc. No.54409 of 2015 (2) dt.01-12-2015 2/2 Charge, Amjhaur. The same has been brought on record as Annexure-3 series. The amount has also been credited in the govt. treasury and the petitioner has already handed over the charge to Shyam Bihari Singh on 24.03.2015.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Dehri-on-Sone in connection with Rohtas (Amjhour) P.S. Case No. 38 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
