This application for anticipatory bail arises out of Sitamarhi P.S. Case N0. 48 of 2011, disclosing offences under Sections 302,304B,498A,120B of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. Petitioner is the mother-in-law of the deceased. Learned counsel for the petitioner has submitted that father-in-law of the deceased has been granted regular bail by this Court by order, dated 15.02.2017 passed in Cr. Misc. No. 5751 of 2017. It is submitted on behalf of the petitioner that there is delay of one year and nine months in lodging of the First Information Report.

Considering the facts and circumstances and the submissions so advanced on behalf of the petitioner, this

application is allowed.

Let the petitioner above named in the event of her arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S. Case No. 48 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
