The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added. The prosecution case is that an altercation took place with regard to non-payment of Rs. 6,000/- to Santosh Gupta by the husband of the informant. It is further alleged that Bittu Kumar poured Kerosene Oil upon the victim while she was cooking food on Gas Oven, as a result she caught fire and sustained burn injury and subsequently succumbed to the injuries.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.54815 of 2015 (2) dt.04-12-2015 petitioners that specific accusation is only been alleged against Bittu Kumar. There is no accusation that the petitioners instigated Bittu Kumar or anyway contributed in pouring Kerosene Oil on the victim. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Surypura P.S. Case No. 79 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
