The petitioners being members of the same family apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/342/ 323/325/307/34 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioner submits that the entire case is false and frivolous and the petitioners have been driven to the present prosecution only because of certain matrimonial differences. It is submitted that in paragraph No. 31 of the case diary, it has emerged that the victim lady had consumed poison and had subsequently been treated. It has also come on record that it was more a case under Section 498A and not otherwise, as stated in the First Information Report.

No.58398 of 2015 (3) dt.06-05-2016 P2/2 Considering the aforementioned facts and circumstances and the veracity of the allegations as has come under a cloud in the case diary, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 101/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
