====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-09-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Section 395 of the IPC.

The prosecution story, in brief, is on 04.02.2019, at about 10.00 P.M. the informant parked his Motorcycle in the Gali of his house, at that time, 10 unknown persons came and entered into his house and out of them one person kept his pistol on his Kanpatti and rest of them entered and closed the door and they were looted Rs. 1,00,000/- cash and jewellery near about Rs. 1,50,000/- and they were also entered into the house of his renter, namely, Prabhat Jee and also looted articles from his house and they all fled away.

The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has come on the basis of self confession made by the petitioner before the police. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Ist, Patna, in connection with Jakkanpur P.S.
