2. The petitioner has preferred this application for grant of regular bail in connection with Riga P.S. Case No. 220 of 2023 dated 13.06.2023 registered for the offences punishable u/ss 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, on seeing the police party, two miscreants started to flee away but they were apprehended. On search, one loaded country made Katta was recovered from the possession of the petitioner whereas one live cartridge was also recovered from the possession of the coaccused.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.64835 of 2023(2) dt.12-10-2023 2/2 that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner and the petitioner has no concern with alleged recovery. The petitioner is accused in two other criminal cases and he is on bail in both the cases as stated in para 3 of the bail petition. The petitioner is in custody since 14.06.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Riga P.S. Case No. 220 of 2023.

7. The application stands allowed.
