2. In this case, the petitioner is seeking regular bail in connection with Patauna P.S. Case No. 42 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 109, 303(2), 352, 351(2), 3(5) of the B.N.S.
3. As per prosecution case, in course of going towards his house, the informant was intercepted by altogether 7 accused persons including the petitioner and further, all of them having armed with weapons, started abusing the informant and on protest, the informant was assaulted.
4. Learned counsel for the petitioner has submitted that there is no allegation on petitioner to inflict on persons of the informant. He further submits that the allegation of assaulting the
Patna High Court CR. MISC. No.66583 of 2024(2) dt.25-09-2024 2/2 informant is against the co-accused persons and the petitioner is a person of clean antecedent. The petitioner is under custody since 19.07.2024.
5. On the other hand, learned APP for the State has vehemently opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani in connection with Patauna P.S. Case No. 42 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
