JUSTICE JYOTI SARAN ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Imamganj P.S. Case No. 63 of 2015 for the offences punishable under Sections 341, 323, 324, 307, 504/34 of Indian Penal Code. Mr. S. Jamil Akhatar, learned counsel for the petitioner submits that there are case and counter case between the parties and that there is injury on the person of the petitioner also. The F.I.R. charges this petitioner of assaulting on the head of the informant which allegation stands confirmed from the injury report placed at Annexure-2 series reporting a sharp cutting wound on the parietal region of the scalp.

No case for anticipatory bail is made out. The prayer is

Patna High Court Cr.Misc. No.55177 of 2015 (2) dt.18-12-2015 2/2 rejected. The petitioner should surrender and pray for regular bail before the court below which shall be considered and disposed of on its own merits by the court below. The anticipatory bail application is dismissed.
