JUSTICE ARUN KUMAR ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kahalgaon P.S. Case No.371 of 2016 registered under Sections 395 and 397 of the Indian Penal Code.

Allegation in brief is that the informant's tractor was intercepted by three miscreants, who came on motorcycle and he unloaded the sand at particular place; after unloading the sand, they took away the tractor and also kidnapped the informant but mhe escaped away from their clutches.

Learned counsel appearing on behalf of the petitioner submits that on suspicion, one Chiku Kumar Yadav was apprehended by the police; except disclosure of name of the petitioner by Chiku, there is no material against him. Neither he

It is also submitted that another accused Manish Raj Mayank, whose name also transpired in confessional statement, has been granted bail by a Co-ordinate Bench of this Court vide order dated 11.4.2017 passed in Cr. Misc. No.16772 of 2017. Having considered the said facts and circumstances, the petitioner, namely, Bittu Kumar @ Krishnadeo Patel is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Kahalgaon P.S. Case No.371 of 2016.
