JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Phulwariya P.S. Case No. 93 of 2019, disclosing offences under Sections 4 447, 302 and 34 of the Indian Penal Code. Allegation as per F.I.R is that on instigation of the petitioner, co-accused persons made indiscriminate firing causing death of the deceased.
Submission of learned counsel for the petitioner is that there is no allegation of firing against the petitioner and he has falsely been implicated in this case due to land dispute between the parties. Further submission is that he has no criminal antecedent and an old person aged about 69 years. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances as well as the age of the petitioner, this
Patna High Court CR. MISC. No.64527 of 2019(2) dt.15-10-2019 2/2 application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XIII, Gopalganj, in connection with Phulwariya P.S. Case No. 93 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
