The petitioner seeks bail in connection with Special Case No. 6849 of 2021 arising out of Danapur P.S. Case No. 755 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.10.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 258.560 litres of liquor from the cowshed of the petitioner and the petitioner was arrested from the place of occurrence.

Patna High Court CR. MISC. No.836 of 2022(2) dt.03-03-2022 2/2 cowshed is an open space hence the petitioner was not knowing who had kept the liquor there and the petitioner was sleeping in his cowshed when he came to be arrested.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 23.10.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna in connection with Special Case No. 6849 of 2021 arising out of Danapur P.S. Case No. 755 of 2021.
