ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Petitioner apprehends his arrest in Khaira P.S. Case No. 83 of 2014 registered for the offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is general and omnibus allegation against 11 persons named in the F.I.R. So far as the petitioner is concerned, his name has been brought into the case only due to local politics even though the petitioner has been residing outside the State. It is further submitted that even if the allegation is taken as a whole it can only be a case of last seen and there is no eye witness to support the allegation in the present case.

No.4337 of 2016 (3) dt.26-04-2016 2/2 Learned counsel for the State submits that the victim was found throttled and save and except the fact that the some hearsay witnesses have stated that the petitioner involved in the occurrence, there is no further cogent material in the case diary to support the allegations.

Considering the aforementioned facts and circumstances the nature of allegation made and the petitioner has no criminal antecedent, let the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S.
