The petitioner apprehends arrest in Sakra P.S. Case No. 264/12 under Sections 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioner, while drawing my attention to the Fardbeyan as contained in Annexure-I, submits that the petitioner is the elder brother of the husband of the deceased and there is no specific allegation against the petitioner. The learned counsel further submits that the petitioner is separate in mess and business with his brother and he has nothing to do with the occurrence as alleged.
On perusal of the impugned order it appears that the husband of the victim has already been granted bail by this Court in Cr. Misc. No. 1696/2017.
Patna High Court Cr.Misc. No.24384 of 2017 (2) dt.05-06-2017 2/2 Learned A.P.P. appearing on behalf of the State could not place any significant material so as to deprive the petitioner from the benefit of the anticipatory bail. In the facts and circumstances of the case I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, namely, Mukesh Singh @ Mukesh Kumar Singh, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge IV-cum-A.C.J.M., Muzaffarpur in Sakra P.S. Case No. 264/12, subject to the conditions under Section 438(2) of the Code of Criminal Procedure. The petitioner will immediately join the investigation and shall co-operate with the I.O.
