JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 379, 120B/34 of the Indian Penal Code. The prosecution case is that when the informant visited her native house, she found lock of the house broken and the articles missing. Co-accused Sanjay Kumar and Satendra Ram were found present in the house and they conveyed to the informant that the house was purchased by their maternal-uncle Baban Ram. It is alleged against the petitioner that petitioner being agnate of the informant executed "Power of Attorney" along with co-accused Bhola Ram with regard to the land, in question, in favour of co-accused, Kanhaiya Pandey, who executed the sale deed in favour of Baban Ram. It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.57087 of 2015 (2) dt.18-12-2015 2/2 that land, in question, was recorded in the name of petitioner, Ram Chandra Ram, Most. Kaushalya Devi amd Most. Rita Devi and he executed "Power of Attorney" with regard to his share of land. Moreover Title Suit No. 181 of 2012 is pending between the parties. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the accusation in the background of civil nature of dispute, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar(T) P.S. Case No. 280 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
