JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 170, 255, 420, 467, 468, 120(B) and 379 of the Indian Penal Code.
The prosecution case is that from the office of the Petrol Pump at G.T. Road, certain forged documents were recovered suggesting that the documents were prepared to evade Sales Tax and V.A.T in transporting the goods from the State of Bihar. The name of the petitioner sprang-up during investigation. It is submitted by learned counsel for the petitioner that nothing has been recovered from his possession and only on suspicion, he has been roped in the present case. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.56585 of 2015 (2) dt.14-12-2015 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya in connection with Barachatti P.S. Case No. 145 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioner shall be accepted on filing affidavit by the petitioner before the learned Court below to the effect that he will co-operate during investigation.
