JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 This application, for grant of anticipatory bail, arises out of Charpokhari P.S. Case No. 116 of 2019, disclosing offences under Sections 363, 366(A), 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant and she is still traceless. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case only on the basis of suspicion and he has no concern with the allegation and has no affair with the alleged victim girl.

Learned counsel for the State opposed the prayer for anticipatory bail on the ground that the victim girl is still traceless and during the investigionat also, name of petitioner

Patna High Court CR. MISC. No.58243 of 2019(4) dt.19-11-2019 2/2 has transpired.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
