JUSTICE SHIVAJI PANDEY ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Dumra P.S. Case No. 40 of 2014 registered u/s 384 & 386 IPC. Allegation has been made that some rolled leaflets were thrown in the premises of the informant which were picked up by the Chaukidar where it has been mentioned that before starting the work, proprietor will have to talk with Bihar Peoples' Libration Army and name of petitioner was printed, except that, in whole of the case diary, no implicating statement has been recorded.

Though the petitioner is carrying 26 criminal cases over his head, looking to the nature of allegation and custody since 17th February 2014, petitioner Santosh Jha @ Santosh Kumar Jha is directed to be released on bail on his furnishing bail bond of

Patna High Court Cr.Misc. No.2513 of 2015 (3) dt.04-03-2015 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S.Case No. 40 of 2014, subject to the conditions that:

(i) one of the bailors will be a close relative of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) that the petitioner would cooperate in the proceeding and if the petitioner will fail to co-operate in the proceeding of the court below and will remain absent for two consecutive dates without reasonable explanation, the court below will pass appropriate order, including cancellation of bail bonds.
