JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 457, 325, 354/34 and 504 of the Indian Penal Code. Prosecution case is that the petitioner entered into the house of the informant and tried to outrage her modesty when the sister of the informant Rekha Kumari came to rescue then petitioner assaulted her with iron rod causing fracture of right leg. It is submitted by learned counsel for the petitioner that for the occurrence on 9.3.2015 at 11 a.m., the fardbeyan was recorded on 10.3.2015 at 2 pm. and the F.I.R. was registered on 12.3.2015 which was received in the court of learned Magistrate on 16.3.2015.
Patna High Court Cr.Misc. No.6472 of 2016 (2) dt.11-02-2016 2/2 It is submitted by learned counsel for the petitioner that informant took loan of Rs.50,000/- from the petitioner and in order to mis-appropriate said amount the present case has been lodged with malicious accusation. The injury report has been procured from a private doctor.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Karakat P.S. Case No.43 of 2015, pending in the court of Sri Anand Kumar Singh, Judicial Magistrate, 1st Class, Bikramganj, Rohtas.
With the above observation, this application is disposed of.
