JUSTICE MADHURESH PRASAD ORAL ORDER 01-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Petitioner seeks bail in connection with Barhaiya PS case no. 181 of 2016 for offences under Sections 366(A)/302/34 of Indian Penal Code and Section 2/8 of POCSO Act.

Learned counsel for the petitioner submits that other co-accused namely Roshan Kumar and Gautam Kumar against whom, identical allegations have been made in the F.I.R. have already been granted bail vide order dated 02.05.2017 passed in Cr.Misc. no. 17957 of 2017.

The aforesaid order is produced in court and from perusal of the same, it is apparent that the case of the petitioner is

Patna High Court Cr.Misc. No.25263 of 2017 (2) dt.01-06-2017 2/2 also on the same footing and the petitioner is in custody since 17.08.2016.

Considering aforesaid facts and circumstances of the case, petitioner Chunnu @ Chunnu Kumar @ Manish Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of Addl. District Judge 1st-cumSpecial Judge (POCSO), Lakhisarai in connection with Barhaiya PS case no. 181 of 2016.
