JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner apprehends his arrest in connection with Kargahar (Sidhi) P.S. Case No. 325/17 registered for the offences punishable under Section 304 (B)/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act. Petitioner happens to be husband of the deceased ans the First Information Report reflects that petitioner used to torture the deceased on account of non fulfillment of illegal demand.
Admittedly, the deceased died within seven years of her marriage in other than normal circumstance. Submission on behalf of the petitioner is that in course of investigation, it came to light that it was petitioner
Patna High Court CR. MISC. No.70512 of 2019(6) dt.03-07-2020 2/2 who took the deceased to hospital for treatment and, as a matter of fact, the deceased was caught in fire accidentally while she was cooking meal.
Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to extend the privilege anticipatory bail to petitioner and, accordingly, his prayer for anticipatory bail stands rejected. (Hemant Kumar Srivastava, J) GAURAV S./- U T
