JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 The petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the IPC.
The prosecution case is that the petitioner applied for being appointed as a Panchayat teacher on the basis of forged BETET certificate.
It is submitted by learned counsel for the petitioner that though, earlier the prayer for anticipatory bail was rejected by a co-ordinate Bench of this Court (now retired) vide Cr. Misc. No. 24615 of 2015 but the prayer has been renewed on the ground that the petitioner has infant child of three months. Moreover, similarly situated accused Dilip Kumar Mehta has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 57357
Patna High Court Cr.Misc. No.6528 of 2016 (2) dt.11-02-2016 2/2 of 2015.
This Court is not inclined to revise the earlier order passed by co-ordinate Bench of this Court (now retired), however, keeping in view that the petitioner is a lady and similarly situated accused person has been granted anticipatory bail, it is a case for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if she surrenders within a period of six weeks in connection with Birpur P.S. Case No. 56 of 2015 pending in the court of learned SDJM, Birpur at Supaul. Accordingly, the application is disposed of.
