The petitioner seeks bail in a case instituted under Sections 307, 326 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that some unknown person shot fire on the back of the husband of the informant, causing serious injury to the injured. Thereafter the injured was brought to Sadar hospital, Madhepura and from there he was referred to P.M.C.H., Patna, where his treatment is going on.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.03.2017. The petitioner is not named in the F.I.R. He has falsely been implicated in the present

Patna High Court Cr.Misc. No.24922 of 2017 (2) dt.01-06-2017 2/2 case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has come only on the basis of confessional statement of co-accused namely Ranjit Goswami. The other co-accused namely Bablu Goswami has been granted bail vide Cr. Misc. No. 31755 of 2016 by another co-ordinate Bench of this Court.

On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sri Shiv Kumar, J.M.1st Class, Uda-Kishunganj, Madhepura, in connection with Puraini P.S. Case No. 14 of 2016.
