JUSTICE SATYAVRAT VERMA ORAL ORDER 03-03-2022 Heard Mr. Vinay Kumar Mishra, learned counsel for the petitioner and Mr. Nityanand, learned APP for the State. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Excise Case No. 272 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.10.2021, is a person with clean antecedent, charge-sheet has been submitted and allegation is of recovery of 16 litres of liquor from the hut the petitioner. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case under

Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and is a person with clean antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.5,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Samastipur in connection with Excise Case No. 272 of 2021.
